Franchising is used to describe a number of business models, the most commonly identified of which is “business format franchising” where the franchisor markets a service, or a product, under a common name and standardised system, through a network of franchisees.

Franchising is a way to scale a business once it is successful and proven. It involves finding franchisees with the skills necessary to operate branches of the same business.

We welcome enquiries to determine whether your business is ready to and can be franchised, and in that time we can cover the marketing options, legal requirements, and explain the advantages and disadvantages of franchising. To schedule an initial consultation, call 1300 977 546.

Construction law falls into two main categories: non-contentious and contentious.

On the non-contentious side, we are involved in negotiating contracts and general procurement, before the actual construction work begins.

Construction law becomes contentious when something goes awry, for example, the project is running late, or terms of the contract have been breached. The contracts drawn up at the procurement stage will set out how any disputes should be dealt with, and usually in an effort to minimise costs it is resolved through adjudication, or arbitration. If a case does go to court, we have the strength and depth to handle even the largest scale, most complex litigation.

At Effective Legal Solutions we can assist with contractual advice, contractual terms, development agreements, adjudication and arbitration, as well as the drafting of formal documentation relating to construction projects. If you have any questions, or to schedule an initial consultation, call 1300 977 546.

Was something not performed to the level you believe you paid for? Is another company arguing you didn’t provide something on time? You can settle your differences through legal proceedings.

It is important that commercial clients who are engaged in the sale of goods and provision of services are aware of their duties and obligations to consumers. If you are a trader seeking to ensure you comply with your obligations, our consumer team offers an in-depth comprehensive service in all consumer matters and can advise and represent you in order to successfully resolve any consumer disputes.

We understand the pressures involved in running a business and know that disputes can arise regardless of who you are in business with, be it friends, family or business colleagues. It might feel like you’re between a rock and a hard place should conflict ever arise between you and your business partners or shareholders.

We have seen many businesses suffer as a consequence of disputes between partners. It is always advisable from the outset to record any agreements or understandings in writing. While this does not guarantee there won’t be disagreements in the future, it does provide for more certainty and helps to reduce the scope for argument.

In addition to resolving disputes, our commercial team can provide proactive advice on how to avoid potential future disputes by preparing documentation in the form of Shareholders’ and Partnership Agreements. These agreements can be drafted in detail in order to regulate proceedings in the event of a dispute.

We have dealt with a wide range of cases involving insolvent companies and individuals, having formed very close links with specialist accountants and insolvency practitioners. Working together, we offer practical and effective advice to struggling companies or companies already in administration or liquidation. Equally, we are able to assist individuals who are having problems with debts and are considering bankruptcy.
